The basis of this claim is that none of the Plaintiffs in the lawsuit were ever actually fined. PPOA now claims that this means no actual enforcement of the C&Rs ever occurred. To see the Motion for Dismissal, please use the link below. HYPERLINK "http://www.ppcma.org/PP_Info/Misc_Info/PPOA_Motion_to_Dismiss_for_Lack_of_Jurisdiction.pdf" http://www.ppcma.org/PP_Info/Misc_Info/PPOA_Motion_to_Dismiss_for_Lack_of_Jurisdiction.pdf This is particularly interesting in light of the fact that on January 24th, 2007, PPOA notified the community that residents would have until March 19th, 2007, to remove stored vehicles from their property. After that date, PPOA said enforcement would begin. To see the January 24th letter, please use the link below. HYPERLINK "http://www.ppcma.org/PP_Info/Misc_Info/BOD_RV_Letter_01-24-2007.doc" http://www.ppcma.org/PP_Info/Misc_Info/BOD_RV_Letter_01-24-2007.doc This letter, giving residents a clear deadline after which C&R enforcement would begin, was the very reason a group of plaintiffs filed for a Temporary Restraining Order (TRO) to stop PPOA from implementing the deadline and subsequent enforcement. This TRO was granted by the court. While a precise total figure has not been made public to our knowledge, PPOA may now have expended what could be a total amount to date in excess of $100,000, when considering both 2007 and 2008 legal costs, not to mention the legal expenses incurred by the plaintiffs! Some rather obvious questions come to mind. If PPOA never actually planned to issue fines, as one might infer from the new Motion, why was this notice sent to the membership in January, 2007? Why was so much PPOA money spent on legal costs directly associated with this lawsuit over the past two fiscal years, if in fact our attorneys feel the case is not ripe? Why didnt this Motion surface early on? While PPCMA has taken no position in this particular legal matter, we are always interested in how PPOA spends OUR MONEY. Please look over the material linked above. This Motion is now scheduled for a Hearing in Hood County District Court on July 2nd, at 9 am. Fire Department News by Chief Dave Raffa During the first 5 months of 2008, the PPVFD ran 95 emergency calls. The summer heat is upon us and the dry weather conditions have created numerous brush fires. Hood County governs the status of burn bans. When there is a burn ban in effect, no burn permits will be issued by PPVFD. Should you wish to burn, contact the Pecan fire station at 817-573-1643. If there is no burn ban in effect, you must obtain a burn permit at the fire station accepting responsibility prior to burning. Congratulations to PPVFD Engineer Leon Frazier, firefighters Stephen Foster and Jim Dreese Jr. for completion of their ECA course. This required nights and weekends of classroom study at the Pecan fire station. They will now take the National Registry exam for certification as Emergency Care Attendant. Congratulations to firefighter David Raffa for passing the National Registry Exam for EMT-Basic and being certified by the Texas Dept. of Health. These National Registry exams for certification are very difficult and require intensive study. We very much appreciate these PPVFD members stepping-up to assist the PPEMS in support of the Pecan residents. The PPVFD & EMS will again lead the July 6th Pecan Parade. We welcome children and their parents to ride on the trucks in the parade. Loading of the children will take place on Orchard Drive adjacent to the Nutcracker driving range just prior to the parade. The drop off point will be on Leisure Lane near the Pecan clubhouse. The Canyon Creek POA presented the PPVFD with a donation check of $1,357 from their recent fundraiser. The Pecan Auxiliary just presented a donation check of $11,000 to the PPVFD & EMS from fund raising efforts during the first half of 2008. Included in this check were proceeds from the Golf Benefit/Raffle, Health Fair and Boot Drive. The Boot Drive generated $2,248. We want to say Thank You to all the Auxiliary members for their hard work and dedication in volunteering their time. Thank You to the Pecan and Canyon Creek residents, contractors and friends who contribute to the fund raisers success. We very much appreciate the great financial support we receive and believe we provide the very best Emergency Services to our residents and friends. Thank You! In closing, the PPVFD, PPEMS and Auxiliary are always looking for volunteers. Should you be interested in donating your time to Pecan Emergency Services, please contact the fire station at 817-573-1643 or come by for a visit to meet Rene, Bill and Boomer! Also, if you are interested in becoming a PPVFD & EMS Board member, please submit your resume and reasons for interest in a sealed envelope to PPVFD & EMS Election committee at the fire station by August 1st. The Board is made up of 7 members including the Pecan Fire and EMS Chiefs and 5 elected members from Pecan. Pecan Plantation EMS News by Chief Sandra Winfield May was extremely busy for EMS; we responded to 74 calls. Thank you for calling on us when you need us. Should there ever be any reason that you feel that we are not able to meet your emergency needs or expectations, please always feel free to call us on the phone or come by and visit with us at the station. If I havent told you all before, you are always welcome at Station 8! If you drop by and no one is available, we will be right back. Our class of eight ECA (Emergency Care Attendant) Students has finished their class and is waiting to complete their National Registry Exams. Thanks go to the class members who have dedicated their time and efforts to this intense and excellent curriculum taught on site through Tech Pro Services out of Abilene by Brad Smith, LP, and Max Smith, LP. The value in the services of our newest volunteers will be realized for years to come. Remember to come by and see us as we stage at the Street dance for the 4th of July at the clubhouse. To members of Pecan Plantation who would consider serving as a member on the Volunteer VFD & EMS BOD, there will be two vacancies after this current term finishes; please send or deliver your resume, by August 1st to Station 8 at 9518 Monticello Dr., and address it to the nominating committee of the Volunteer VFD & EMS BOD. See you all at the 4th of July Street Dance Sandra Winfield, RN, NREMT-P, Lic P Chief, PPEMS Helicopter Program Update For anyone interested in the recently formed (non-PPCMA) group that has taken advantage of Careflites discounted plan, PPCMA received the following letter from Jake Cook, who was the original organizer. We had a meeting today with two gentlemen who have agreed to relieve me of my duties and take over the Group started here in Pecan Plantation. They are: James Redwine, 9501 Bellechase Rd. (817-279-8417) and Gary Newell, 8913 Brierfield (817-579-8808). They have some great ideas for the future operation of the Group. Again I thank everyone who has helped us get this started and am sure with the leadership of these men, it will grow. Jake Cook Thanks for reading and helping to "spread the word!"
